I 'think' it's shaky TV ground having Zack work on the case. It's more that they are using his insight on the file than having him actively working evidence that'll be presented in court. Much in the same way Booth has utilised help from the stalker. Again not someone the prosecution is likely to use in court. But yeah in the real world, they would likely get in a massive amount of trouble letting non sanctioned people see case files, I should think. Other writing liberties. Having a character behave in a more unreasonable way for more comic affect. Particularly to stage a misunderstanding in this case. Then prolong it further amusing character interactions. Obviously these should be within the spirit of the character. But occasionally it's as much for the laughs than anything deeper. They seem to want the little office dramas as much as they are interested in proper character progression some times.
