Being able to copy quirks is obviously OP if used the right way. But technically speaking, he needs to touch the person to copy the quirk and it'll only last for about 10 minutes. He can't be a hero alone, he's basically quirkless if he's not able to copy.

I had to pull up a picture and compare too. They look similar but if you pay attention to the details you can tell it's not actually him. The costume has a green spike bang type thing coming up from his forehead there's more white in the hair and a few other differences. Probably it's a character related to Crust though. Like how Iida's family all are heroes with engine speed type quirks.
