Nintendo’s reputation for being an extremely litigious company continues. Over the past two weeks, their latest target was Yuzu, a popular Nintendo Switch emulator. While there has been legal precedent that emulation and game backups are legal, Nintendo makes the case that Yuzu has opened the floodgates for piracy, specifically citing that The Legend of Zelda: Tears of the Kingdom was downloaded over a million times for use on the emulator a week before launch. In addition, Yuzu, while not directly hosting game files and Nintendo Switch BIOS and decryption files, paved a clear and easy way for its users to acquire them. So who’s in the right and who’s wrong? The Punching Up crew agrees that there’s obviously a place for emulation and game preservation, but when does piracy take things too far? Let’s dive in.

Anytime I hear Gene talk about Pokemon I imagine Joe Merrick crying in a corner somewhere 🤣 Also I bought my first switch (OG Baby) after a college break up, got the Grey Switch with BOTW Collector’s edition, realised shit I needed that money and sold it again a week later… next one I bought was the Super Smash Bros edition on release day, kept that for years, then I decided I wanted to move to a Lite so sold it and got the BD/SP edition, also picked up the Sword and Shield edition for collection purposes… then the OLED came out, bought the white one & Dread together, Dread looked amazing on it. Then Scarlet and Violet edition got announced so bought that and sold the white one, and then finally… the TOTK one got announced so I bought it and sold the Pokemon one + the lites and will hopefully never change it again until Switch 2🤣

The Switch was the first console I bought launch day, but I was very passive aggressive, indifferent about it. Very much the tsundere, "I'll get one if they still have them, but it's not like you." I was working odd retail hours at the time, so was up at 1AM launch night, just getting off a Skype hangout with friends. I had a few hours to kill, so decided to wing it and see if they had any left from the midnight launch. My local Meijer had 3. Before that, I tended to always wait a year to get a console. Usually with a good bundle like my glacier white Destiny PS4.
