Yes Light returned the death note to Ryuk, losing his memories of it in the process, in episode 16 while he was in the cell. It was his plan to clear his and Misa’s names. So he has not been acting, but genuinely trying to catch Kira since then

Also having touched a piece of Higuchis death note, misa does not become the owner, it just means she is able to see Rem again. However rem will kill people on Misa’s behalf just because she is personally invested in Misa’s safety

To answer your second question: Higuchi (the scumbag Kira) is the current owner of the Death Note that Misa originally had. Per the rules of the Death note, the Shinigami that is tied to that Death note will follow the designated owner. As such, the only obligation is that Rem will follow him and be by his side. Rem's true feelings fall to Misa, so Rem killing the random company president doesn't go against any rules. The fact that Misa touched the Death note piece of paper only grants her the ability to see Shinigami. It does not make her the designated new owner.
