I believe the answer is C. Article II, section 2, 2nd paragraph states “he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors ......,whose Appointment are not herein otherwise provided for, and which shall be established by Law...” A statute is a law passed by Congress, so it is consistent with the constitutional requirement.

The answer is B. The President nominates ambassadors, not the Senate. If the Senate nominated ambassadors that would erode separation of powers, and we only do that to undermine the Legislative, not strengthen it.
