Thomas once again analyzed this properly but picked the wrong answer at the last minute, choosing (D) instead of the correct answer, (A).  He's now at 59% over the past 38 questions.

Thomas is really going to be kicking himself over this one. He reasoned everything perfectly, then veered away from the right answer at the very end. It's like in Mario Kart when you're cruising towards the finish line and fire off a shell in celebration, but it bounces back and knocks you out.

If I were to get this question on the bar, I would just think of the policy considerations. Courts generally make rules to promote judicial efficiency - they don't want to decide a case if it wouldn't change anything. Also, federal courts don't issue advisory opinions, which is essentially what that would be.
