So what's the difference between this and the concert mass shooting case, where the hotel was suing people to stop them from suing the hotel?

I was thrown off by the idea in answer D that there is not a judicable controversy. The question of whether the Bureau can prohibit pasteurized beer IS a judicable controversy. But it only can be considered once the Bureau actually takes that step. I suppose the word judicable can be interpreted in different ways. I took it to mean "theoretically within the court's purview", but here it means "something which the court can and should consider at the present moment."
