IANAL, but in real world this would be under New York state penal code. Depending on how the D.A. would argue the case it could be a direct New York Penal Law § 125.27: Murder in the first degree, but from my layman's perspective it's at least New York Penal Law § 105.15: Conspiracy in the second degree. "[...] you have committed the crime of conspiracy in the second degree if you plan with at least one other person to commit a Class A felony.
