I think Gus pointing out that all those photos in the apt were taken inside there, it was supposed to be implied that random forensics guy took them all. But I agree with you, when you stop and think about the details and the timeline of this episode it doesn't make much sense. This episode does have some great moments though, so it's easier to ignore the odd things.
