I will absolutely judge an anime based on the quality of their knock off McDonalds brand.

Trademark & Likeness - Including Real World People & Brands in Your Game - Extra Credits

Thanks to Joe Newman ( https://www.fenwick.com/people/joseph-newman ) & Rebecca Fewkes ( https://www.fenwick.com/people/rebecca-a-e-fewkes ) for their legal expertise on this episode! We talked a little bit about video game copyright law beforehand but let's talk about including real-world brands and people in your game. Trademark and visual likeness is similar to copyright but has a few key differences that can make or break your case for fair use. So could you include a McDonalds in your game? Or would it have to be MacBonald? And if a person is dead, does that mean you can use their face without issue? Well, it can depend on how you're using it! I am still disappointed over the original Plants & Zombies changing the appearance of the dancing zombie due to a similarity to a deceased pop idol, but I can understand the company wanting to avoid legal trouble with the performer's estate.

Fun and clear, and well-placed statement that "This isn't legal advice." :)
