Nah it makes total sense. Roy isn’t a war criminal because there in no national or international law (that we’re aware of) that would condemn him as such. In fact, he’s likely considered a war hero by the Amestrians. However, morally speaking, he committed grave acts against the Ishvalans. And by our standard of law, he would a war criminal.

About "War Criminal", We Japanese thinks it all depends whether the subjects or their country won the war. We have lots of "War Criminal" from WW2 in Japan but that is simply because we lost the war and they were judged by the Allies. Technically, there are ppl/soldiers that did bad thing(almost as bad as Japanese) in U.S. too, but they are considered "War Heroes" because they are on the other side of the table. IF Axis won the WW2, I think there were lots of war criminal in U.S. and we probably enshrine the Japanese soldiers as war heroes. So in this scenario, Roy is not war criminal but war hero, simply because he won the war. It has nothing to do with either what they did is good or bad.

To argue whether Roy is a war criminial you'd have to agree on what you mean by that. By definition, to be a war criminal you'd have to violate the international rules of war. Since we have absolutely no way of knowing the rules of war of FMA it's hard to say, but to condemn Roy as a war criminal there would have to be a rule against the stuff he did (I guess, specifically killing people with alchemy or with fire in war). Of course it doesn't change the fact that it is ethically messed up, but then again, so is war in general.

Roy isn't considered a war criminal unless he violated laws of war previously established by Amestria, since it was a civil, not international war. What the state alchemist did doesn't seem to violate any of their laws because the King ordered it and he makes the rules. Its no different than bombing a city in an enemy country. Instead of dropping bombs from a plane, the alchemist use their alchemy to blow them up
