in fact it's not only lego suing people for calling other brick-brands "lego". the figurines are a big issue, themselves. one of the last trademarks that lego has, is a 3D-trademark for the figures. at the moment there is big trouble (mainly because of figures) going on in germany. there are some merchants, that want to import and sell brick-sets from chinese companies and lego does everything to stop them - and their main point is that figures, even if there is a minimal ressemblance (like clip-hands etc.) hurt their trademarks... much bullshit going. don't know about american copyright-laws, but at the moment it would be a bit risky
