Anticipating a gunfight, the hitmen are wearing Kevlar vests. But there ain't no Kevlar socks.

And if you carry a gun, always have spare ammo close to hand. You don't get to decide in advance how many shots it will take to settle the fight.

On a related note, if you were the gunman who just got shot/nicked, would it have been more effective to fire a burst onto the ground under the car and hope to get the othershooter with a ricochet?

It looks cowardly, but it's a sound tactical decision. They don't have the ammo or the backup to out-shoot a bunch of cops swarming in on reports of gunfire. So they call this target a 'failure' and escape to get the next one on the list.
