Kuro's plan is to have his crew ransack the village and kill a bunch of random people. Then, after Jango hypnotizes Kaya to write her will, when he kills her, it will just look like the invading pirates did it. So, if everything goes according to plan, it literally doesn't matter that he killed Merry. It'll just look like another death at the hands of the pirates. That being said, making plans is both Kuro's strength and his fatal flaw... (also, I'll raise you a Skimbleshanks)
