After a slow start to 2021, news has finally arrived via a rather compelling trio of items germane to our show. For starters, Ratchet & Clank: Rift Apart finally has a release date on PlayStation 5, while HBO's planned The Last of Us series casts both its Joel and Ellie. We chat about both in great detail. But perhaps the most intriguing piece of news comes in the form of Six Days in Fallujah. Yes, -that- Six Days in Fallujah, the third-person tactical shooter that was virtually finished in 2009, only to be unceremoniously cancelled due to perceived audience outrage. Yet, the game is returning -- remade and now in first-person -- and it will indeed endeavor to tell the story of The Battle of Fallujah, the bloodiest engagement American forces took place in throughout the entire Iraq War. It's a controversial move for many reasons (not least of which due to claims of war crimes during the engagement), but are we glad it's coming back? We sure are! Plus: GTAV is still selling millions and millions (and millions) of copies, a bunch of publishers talk sales data and financial performance, and more. Then: Listener inquiries! How the fuck has Chris not finished Crash 4 yet?? It's the best Crash game! Also, it runs with an unlocked frame rate, hitting 60 mostly on PS4 Pro and One X, with the base consoles running inconsistently between 30 and 60.

I loathe WB Games as a publisher. That said, patenting their (self developed) Nemesis system is a logical business move I can support. If my company and its people put all this work into developing this potentially awesome new gameplay mechanic... Why should others be free to profit off my creation? It's a Unique Added Value you can only experience in WB Games titles. In the future, perhaps the tech/software could be licensed out for a fee. Any creatives who are suddenly stymied by this development can just work around the patent and develop their own system of feuds, hierarchies and what not. Good on WB for patenting the thing they made.

In the new God of Was teaser promo, we see at the end “Ragnarok is coming”, but don’t see an actual title card. Sony just tweeted out about their most anticipated games of the year and they refer to Ratchet and Clank Rift Apart, Horizon Forbidden West, AND “the next God of War”. Did Sony just spoil that the new God of War is not actually called Ragnarok? Am I crazy?!

Hey Colin, not only Borderlands 3 adds a new trophy list on ps5, but it also has 2 trophies that are bugged, preventing anyone from getting the platinum! I was starting to get into it, then I noticed it and I abandoned the game! It’s been months since the release and they haven’t fixed it yet, and I feel nobody’s talking about it!

I really think Colin is over estimating the value of insomniac. When Sony bought Insomniac the IP it owned was negligible, except for Sunset Overdrive. Also these studio acquisitions that boast tens of millions aren’t usually guaranteed liquid cash. There are usually deals in place like X-Amount of dollars upfront. Then X-Amount on backend is sales are met/ exceed expectations. Also in my earlier point, most of these other studios being acquired own more IP. Or they act as an publishing arm, which makes them more valuable.

I’m surprised Chris is so certain that Crash 4 runs at 30fps on PS5. It runs at flat 60 on PS4pro, and I can’t see it getting downgraded for the PS5

Love the show, been a patron since the beginning. I'm an IP lawyer, so I think I can help clarify some of the WB concerns. Patents are for inventions, trademarks are for names, logos, etc. You can't patent the "look and feel" of something or an entire genre. There's very little that is even patentable in a video game since a set of rules is typically too abstract. At most, you could get patent protection on some kind of narrow system, and that's what this patent is specifically focused on. The patent in question, No. 10,926,179, is essentially directed to the specific Nemesis system in these games. The PTO pushed back hard on this application, citing, among other references, a similar system in Crusader Kings to narrow the scope of the application. The final claims are certainly broader than most video game patents, but are still pretty narrow and easy to design around. There are some esoteric legal reasons why I think this patent is even weaker than most of the articles suggest, and it wouldn't surprise me if WB decides not to try to enforce it. I'd wait until the patent finally issues on February 23, the claims listed in the published application were narrowed during the process and don't reflect what WB actually has protected. I think most of the articles looked at that application and were concerned about the breadth of the claims, but the actual patent is much more focused to the specific Nemesis system.

This is a spoiler for the AWE Control dlc, the one with Alan Wake in it. So in the end they tease that Alan Wake is going to escape the typewriter and that there's going to be a continuation to Alan Wake, don't know if it'll be tied to Control or it will be its own game but I'm excited nonetheless.
