Chuck had Earnie change the battery in the tape player and left it on on purpose so he could get Earnie to tip Jimmy off to it, so he would break in to steal it. He couldn’t use the tape in court so he wanted to trap Jimmy for breaking the law that way, with the private security guard as his witness.
