There's this phrase - reasonable expectation - that means you can be found at fault for being the cause of a death that is reasonably foreseeable as a result of your actions. This is just for legal crap ( in the US anyway; not sure how it works in Japan... I have a feeling they'd use the harshest legal grounds on Kira ). While L is not actively thinking "I will kill you", he is thinking in terms that would qualify as manslaughter were the law on Light's side, ie the government-sanctioned execution is L's "Death Note". Neither of them need to directly see the deaths, but they cause the dominoes to fall. That's how I think about it anyway. But yes!
