from my old existing rules->

 

These rules are the same as always, but now with a nice format that is easy to follow.
 

Adoptable/Design purchase TOS:
 

1. Any adoptable created by myself will never be used in commercial  works.  No books, magazines, videogames, etc.  You may not profit in any  way off of my design.
2. All designs created by me are intellectual property of me.  Who owns  the character is irrelevant, the design is created by me, therefore it  belongs to me.  
3. You may commission art, plushies, pillows, whatever you like of the  character you have adopted.  This is absolutely and 100% fine! That  would be the point in buying an adoptable, no?
4. Credit must be given to me as original creator on each posting of  said adoptable.  Much like how Mick39 requires all users who draw  sergals to state “Sergals © Mick39,” I require the same of my designs.  A  simple “Original design by Adiago” will suffice, with a link to my  furaffinity, twitter, weasyl, sofurry or other art site of your choosing  that I am on.
5. You may make small changes to hairstyles or tweak markings slightly, you may also change the gender to whatever you wish. (generic adoptables, not specific species)
6. 6. You MAY resell adopted (paid for) characters but not for more than  you have initially paid. Failure to adhere to these rules results in my  repossession of the character.
7. You may NOT resell adoptables 'given' to you, nor may you give them away without consent  from me.  If I am uncomfortable with it, I retain full rights to repo  the character and do with it as I see fit. Likewise, if you argue with  me about waning to throw the character away, or give to a stranger, I  will simply repo the design.  These are my intellectual property, I will  not have them uncredited, abused, and thrown away for no reason.
 

Subsection A. Please realize, that the adoptables I sell, I often make for myself  and end up selling due to finances or feeling as though I cant give  them enough love.  Your mistreating my hard work/design hurts me too.   This is why I do not accept “gifted characters” being rehomed.  If you  have a problem with a character, lose interest, whatever.  You can give  it back to me.  I will either keep it or find a new home for the  character.  If you have invested a significant sum of money in artwork,  you must STILL adhere to these rules.  Failure to do so will result in  forfeiting your rights to my design work.
 

Subsection B.  On a case by case basis only, if you wish to rehome a  character and have spent a significant sum of money on said character in  artwork, contact me and I will offer to auction the character for you.   I will collect a sum of the auctioned price, and the original buyer  will receive the rest.  The exact terms of said agreement will be based  entirely on the situation.  The new buyer (3rd party) will have to  adhere to and respect the above rules as well.
 

Original species/personal species design TOS:
1. Buyers of rift drakes, veils or other creatures residing in my world  'Emain' are restricted to the rules of that world.  In emain only males  and females exist.  Rules regarding other species from other universes  of mine will be stated in individual adoption listings.
2. Buyers right for personal species adoptables are as follows, nonprofit only.  
3. You may not use my species in any commercial work such as novels,  manga, comics, anime, cartoons, etc.  Private and public (free) versions  of all of these are 100% OK.
4. Credit must be given on each submission featuring the character.   Credit is as follows- If purchasing an original species:  Species-name©Adiago, Design by Adiago.  
 

Failure to adhere to any of these basic rules, will result in  repossession of the character/design.  Any work you have commissioned of  the character will remain yours (unless drawn by myself), however the  character rights itself will belong to me in full, with full liberty to  blacklist you and resell the design at my own discretion.
