I suppose they can merely rate limit when they can tell its video traffic vs. actually transcode

That's what I"m assuming as well. Security Now mentioned it as well, on July 26th. So I figure there some how detecting the overall HTTP/HTTPS connection and choking the connection such that Netflix is optimzing down the video to accommodate what appears to be reduced bandwidth.
