Yes, Ears was killed during te last battle. He was a part of the coup. The anime didn't show it, but IIRC, in the manga they used his head as a target for arrows.

“Thorfinn’s most hated thing in life: philosophy,” “He’s much more likely to create a hell than he is to create a paradise of any kind,” “More wine! More focus on wine! Zoom in on the wine. That’s some suspicious wine,” “You find out who you really are with power,” “It’s like a demon in the hearts of men,” “Anything that allows you to take off the limits that are not self-imposed, but are circumstantially imposed, creates a larger area than you can fill, and then you end up filling it out with what you are,” “He got hit with a ‘Your Mama’ insult, so much so that he left the astral plane,” “Thorfinn could use a girlfriend,” “Thorfinn is some kind of silent carrier of Thors that is not expressed, like some kind of latent morality gene,”

In case it was unclear, the king didn't know about Askeladd previously or find out some secret of his. He basically guessed, this guy wasn't named by his father so he and his mother were probably unimportant to him, plus his name means "covered in ash", so it tracks he must have been born to a slave. Obviously this is a point of anger for him.

Schrodinger's Chekhov's Grape. A grape that both does and does not exist, but if it does, it must be revealed as poison by the third act. A classic literary device.
