【國際冷知識🇺🇸🇬🇧】香港公務員宣誓，不可能和英美入籍宣誓相容 (Patreon)

香港全體近二十萬公務員+contract staffs集體宣誓盛事，萬眾矚目。有外國護照、或打算入籍外國的香港公務員應否宣誓？

我們且看英國入籍宣誓誓言為例子：

I, (name), swear by Almighty God that, on becoming a British citizen, I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth the Second, Her Heirs and Successors, according to law.

然後，在重申一次：

I (name) do solemnly, sincerely and truly declare and affirm that on becoming a British Citizen, I will be faithful and bear true allegiance to her Majesty Queen Elizabeth the Second, her Heirs and Successors, according to law.

2004年開始，參考其他英聯邦做法，加上了以下核心價值宣言：

I will give my loyalty to the United Kingdom and respect its rights and freedoms. I will uphold its democratic values. I will observe its laws faithfully and fulfill my duties and obligations as a British citizen.

這裏清楚說明，以英國君主為效忠對象，而在君主立憲制，君主自然代表整個英國政府和制度。加上新增的核心價值宣言，明言要堅守民主價值觀，由於效忠對象是英國，「民主」的定義自然不是中國的、而是英國的。

這樣的誓詞，怎樣可能不與「效忠中華人民共和國」相衝？至於宣誓後才要加入英籍的人，由於宣言強調「堅守民主價值觀」，而又沒有明確內容去抵銷從前作出過的宣誓，入籍者從前的宣誓與他將來「堅守民主價值觀」的責任有否牴觸，就需要英國政府逐一研判。

至於入籍美國的誓詞，對忠誠度的要求更具體：

I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which I have heretofore been a subject or citizen; that I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I will bear arms on behalf of the United States when required by the law; that I will perform noncombatant service in the Armed Forces of the United States when required by the law; that I will perform work of national importance under civilian direction when required by the law; and that I take this obligation freely without any mental reservation or purpose of evasion; so help me God.

這裏首先說明，成為了美國人，就不可能對他/她從前的國家忠誠，因為他/她已經「完全徹底斷絕、並徹底放棄對我迄今為止所隸屬或作為其公民的任何外國王子、當權者、國家或君主的效忠和忠誠」。

另一段，更充滿鬥爭意識：「我將支持和捍衛美利堅合眾國憲法和法律，反對國內外一切敵人；我將信念堅定，忠誠不渝；我將根據法律要求，為美國拿起武器；我將根據法律要求在美國武裝部隊中執行非作戰服務；我將根據法律要求，在文職政府領導下從事對國家具有重要性的工作。我自願承擔這一義務，毫無保留，決不逃避。」

一個宣誓效忠中華人民共和國的人，要是同時持有美國護照，會有甚麼後果，不言而喻。
