B. The person bringing the suit gets to choose where to bring it, assuming both options are valid. D. However, nothing changed in the legal situation to prompt the move to federal court, so maybe it gets sent back? C. Seems unlikely, but maybe if the state and fed laws overlap, there could be a financial bar to meet. A. Is right out, no way they would split this into two cases.

I'm going with D. I have no idea what the legal arguments are, but "the man's friend, who was an attorney" suggests one of two possibilities: either it's relevant that the friend wasn't acting as the man's attorney (which doesn't seem to be the case here), or the friend just isn't a very good attorney. So I'm going to guess that the friend gave bad advice and the boss prevailed.
