A recent episode of the Rationally Speaking Podcast featured Originalist Law professor William Baude arguing for why judges should be originalist. Needless to say, it was not a good case and strawman arguments abounded. Andrew is here to give us part 2 of the deep-dive that will set the record straight on why originalism is still bad.

I don't know who does "Rationally Speaking" or if they care about the content they generate. But these two episodes were a master class in the absolute bullshit so called conservatives have been slinging for the past 30 years.

Listening to the explanation of the T3BE answer, I was struck by this exchange: Thomas: I will have peed and I will walk out with the toilet paper on my foot, and it’ll be like “burglary!” Andrew: What you must have is you must illegally enter a building. Thomas: Yup. Andrew: That is prong one, and you must, number two... I have no idea how Thomas stopped himself from saying "Not number two - I just peed!" Maybe he's just not as juvenile as me.
