A. False or misleading commercial speech is not protected. For now... until a Justice Barrett forgets that part of first amendment law too, and the howler monkeys hold that states can't regulate false, misleading, or deceptive commercial speech. #T3BE

B. The speech shouldn't be strictly liable but to determine if they are liable at all they have to go to discovery.
