As a lay person, footnote at best, I don't think it adds anything to your credibility, as the author of the Amicus brief.

Nitpick from a layperson who doesn’t know how these things are done typically: the very last sentence says “a criminal defendant that” but I think it should be “a criminal defendant who” since he is still (probably) a human person. Could also be “whom” since he’s the subject of that lesser clause but part of the object of the sentence as a whole. Never been great about that.

Ok from the updates I see this changed a lot. I’ll refrain from that kind of grammatical suggestion until the very end
