I would eliminate A&B. Between C&D, I choose C because, while deducting recoverable damages is reasonable, there's no way to know what those damages are until the landowner hires a new builder and so forth. The fact pattern doesn't provide any info on that at all. So, logically, the landowner would have to pay for the building that's done, and then sue for damages over the two that aren't.
