Mike Masnick from TechDirt reports that an LA Court sent a DMCA takedown notice to YouTube after a recording of a Britney Spears hearing was uploaded. The Court expressly forbids third-party recording or streaming of court hearings. But the DMCA is for Copyright violations - and that's not copyright. Let's review.

If one takes a video without permission do they generally own that copyright? It sounds like for this case, yes. But three hypotheticals if I go to Hamilton on Broadway and take a video successfully do I own the copyright to my copy? If I go to a movie theater? If I am in a public space and someone is performing something they don't want recorded?

Patreon comments don't work well on mobile. This video just got me wondering. I'd guess you don't own in the case of recording a film, that's just making a copy in the same medium.

Not sure if you meant this as a question inspired by but not directly related to this video, or as a potential defense the court could bring up, but if the latter, I think the point here was that to make a DMCA claim, the claimant needs to be the one with the copyright. It's not enough that the person who posted the video does not have the copyright, and in using the DMCA to take down the video, the court represented that the court itself held the copyright.

Not directly related to the video, more inspired by it. As I understood things, the video referenced here specifically the copyright was not owned by the court, which means the court would have to use other methods to stop the publishing of the video (contempt). So this made me wonder who owns the copyright to the footage in other scenarios where the video creation isn't authorized or allowed.
