So when Kai killed himself at Jo's and Rick's wedding he was the leader of the coven because he had previously merged with Luke. In TVD we were told, that if the leader of the Gemini Coven dies so do all members of the coven. In their final moments the coven transfered the twins into Caroline to making them the only two Gemini left. When they come of age the merge will determine who will be the leader of the coven. And as Josie pointed out, it is a curse put on the twins. In TVD I think it was never called a curse and I don't know if they had that curse idea in their head at that point. Kai und Jo got out of the merge because Kai was sent to a prison world and Jo gave up magic. But there were other Gemini twins alive so they could merge later on. As long as they were alive that assured that there can be an other leader later on. The leader before was Kai was his dad. But we don't know what happens when the twins don't merge maybe they will forced to merge ?

Yes, it's one of the things the show doesn't properly explain. It wasn't a curse in tvd, because Liv and her brother made it seem like their father was why they were pushed to merge. He was the big reason commanding them to do it when they didn't truly have to. In Legacies it seems to be a different thing. But then, the siphoning is also different. In Tvd it hurt Bonnie a lot, every time Kai would take magic from her. While here the twins can draw magic from their friends and their friends never look to be in pain. For example Josie siphoned from Raphael when she kissed him in one of the first episodes, and it didn't hurt him.
