In recent gaming legal news, TakeTwo successfuly defended itself from a lawsuit where a tattoo artist's work was featured on LaBron James character model in the NBA 2K game series. The artist, Jimmy Hayden, claimed that the use of his tattoos in the games was copyright infringement. It was deemed the depictions of the tattoos were fair use since LaBron gave the approval for the games to feature his likeness. My question is does this outcome set a new precedent? Could NBA 2K include copywriten tattoo art in its character creator? Could a hypothetical developer make a tattoo art game featuring art from tattoo artists without compensating them as long as they got permission from the people wearing the tattoos?
