I think the interesting thing about 50 Shades that Jenny Trout pointed out is how the characters don't hold up unless you're imagining the characters from Twilight. They don't get any individual build up, especially the side characters. That's where the fanfic fingerprints most show, and it's more of a case of bad writing than legality in the end. What further blurs the lines even more is that all writing is in conversation with other media. Many books (I'm not as sure about movies, shows, etc. but I assume this also happens outside of literature) are direct responses to other peoples work.
