it's not that they think it was his dad, but they mentioned that it was enough for a jury to have reasonable doubt. and that's all that's needed for the whole thing to be dropped.

Here's my question, though: How did Kurt even know to look for Matt's body in the incinerator place? Unless he was actually following Dexter (for some reason)... which was never shown, as far as I know.

ok so its ash...but its an incinerator so why would he be suspicious of it? who even owns it that dexter would have access to it? honestly anyone could drive up there and use it since there was no lock or security. so no reason for him to think its dexter, no reason for him to think its his son's body that's burning, this is all very sloppy writing like that ep with the csi guy. "he stumbled back and oh the rock is missing".......like no reason for him to know that there was a rock there
