I think they are labeled as a pirates for stealing treasures and such, trespassing islands they are not supposed to etc. Also as soon as they enter in conflict with marines and beat them up, travel the sea and raise a flag proudly you are an enemy to the marines so a pirate in the end. Robin and Zoro are ex assassins as well, Nami a stealer, they re not the worst but in real life they would be criminals sailing the sea, not just adventurers

smoker is the good marine. its why when he was introduced and the girl dropped her icecream on his pants..he was nice to her and gave her money to buy a new cone. This was done to show he is a good guy. Unlike other people we've seen who would hurt the girl for it.

The whole marine and world government thing! Yeah that really is one of those points where the morality of characters matter on how they influence the story! Because if not now even after 950 eps and 997 chapters later but sometime in the future this topic will have a big impact in the future of this story, is what i think.

Pirates don't have to be evil, pirates in the One Piece universe are just free on the ocean to do whatever they want. The World Government/Marines will label you a criminal for anything if they don't agree with it, whether or not you did anything wrong. Pirates just don't bow down to the government. Being a pirate doesn't make you evil. In the same way the WG/Marines are just labeling themselves as the good guys cause they're the ones in power. Remember that the Goa Kingdom is a nation of the World Government and is gonna burn away an entire homeless camp cause they're ashamed of it. You can't compare the One Piece world to modern society because the governement in One Piece doesn't even acknowledge basic human rights. The government in One Piece is comparable to a military dictatorship. Yes there are countries like Alabasta that aspire to be good and treat their citizens well, but they do this by choice, not because it's something that the World Government cares about, as we can see in Sabaody where Navy Headquarters is right around the corner and they just turn a blind eye to publicly save face.
