I get asked this a lot! Here are the essential elements to any release form

  1. Identification of the parties: The model release form should clearly identify the parties involved, including the photographer, the model, and any third-party recipients of the images.
  2. Description of the images: The form should include a description of the images, including the intended use of the photographs and any accompanying text.
  3. Authorization for use: The model release form should include a clear statement that the model authorizes the photographer to use and distribute the images in accordance with the specified terms and conditions.
  4. Compensation: If the photographer or third parties will be compensating the model for the use of the images, this should be specified in the form.
  5. Exclusivity: If the model is granting exclusivity to the photographer for the use of the images, this should be clearly stated in the form.
  6. Release of liability: The model release form should include a release of liability, stating that the model releases the photographer and any other parties from any liability that may arise from the use of the images.
  7. Signature and date: The model release form should be signed and dated by both the model and the photographer to confirm agreement to the specified terms and conditions.

Here are some example terms and conditions

  1. The specific purpose of the photographs, such as commercial use, editorial use, or personal use.
  2. The duration of the agreement, including any limitations on the use of the images.
  3. Whether the photographs will be used exclusively by the photographer or whether they can be licensed or sold to third parties.
