利用規約

この利用規約(以下「本規約」といいます。)は、りんりんね(以下「当方」といいます。)が pixivFANBOX において開設するファンボックス(以下「当ファンボックス」といいます。)のお客様(当ファンボックスを閲覧するすべての者を意味します。)によるご利用、および当方が支援に対するお返しとして当ファンボックスを通じて支援者様に提供するコンテンツその他特典 (以下「本コンテンツ」といいます。)のご利用について定めるものです。

当ファンボックスをご利用いただく場合、および当方にご支援いただく場合は、あらかじめ本規約にご同意いただいた上でご利用・ご支援くださいますようお願いいたします。

1. (当ファンボックスの運営)

(1) 当方による新たな本コンテンツの提供は、どの支援プランにおいても1か月あたり2回程度を目処とします。ただし、提供回数を保証するものではございません。

(2) 地震、停電、火災、事故、病気その他の不可抗力、当方が利用する通信回線、通信機器もしくはパソコンなど情報端末その他の機器または pixivFANBOX の不具合もしくはメンテナンス等による利用不能、その他当方の責任ではないやむを得ない事象が生じたことにより本コンテンツの提供が困難であると当方が判断したときは、当方が定めた期間において、当ファンボックスおよび本コンテンツの全部または一部の提供および新規提供を停止することができるものとします。

(3) 当方は、お客様に事前に通知することなく、本コンテンツその他当ファンボックス内で当方が公開したコンテンツの全部または一部を削除もしくは変更し、または公開を中断することができるものとします。

(4) 当方は、お客様に事前に通知することなく、当ファンボックスの運営を中断または終了する場合がございます。

(5) 支援額が 5000 円を超える支援プランにおいて、本コンテンツの一部として若干セクシーであると感じられる表現を含むものを提供する場合がございます。あらかじめご理解いただいた上でのご支援をお願いいたします。

(6) 当方は、お客様から投稿されたコメントが 3.(禁止事項)に該当すると判断したとき

は、お客様への事前の通知なくそのコメントを削除することができるものとします。

2. (権利帰属)

本コンテンツに限らず、当ファンボックス内のすべての画像、テキスト、映像、音声その他のコンテンツは、当方または第三者に帰属しています。お客様は、本コンテンツその他当方が公開したコンテンツおよび他のお客様が投稿したコメントについて、当方の事前の明確な許諾を得る事なく、これらのコンテンツおよびコメントの複製、公衆送信、改変、譲渡、販売、貸与その他の利用をすることはできません。

3. (禁止事項)

当ファンボックスおよび本コンテンツの利用に関して、お客様による以下の行為を禁止します。

① 法令または本規約に違反する行為

② 当ファンボックス内であるかどうかを問わず、またコメントやブログ記事、SNS

投稿などその公開方法や実行方法、場所、目的を問わず、当方または第三者(他の 支援者様やお客様を含みます。)に損害もしくは不利益を与え、または信用、名誉、 権利を損なう行為(そのおそれのある行為も含みます。)

4. (免責)

(1) 当方は、当ファンボックスの運営および当ファンボックスに掲載されているすべてのコンテンツについて、その正確性、有用性、真実性、確実性、継続性および第三者の権利を侵害しないことについて保証するものではございません。

(2) 本規約に基づく当方の対応を含み、当ファンボックスのご利用に関連してお客様に不利益や損害が生じた場合においても、その主な原因が当方の故意または重大な過失によるものであることが立証された場合を除き、当方は一切の責任を負わないものとします。

5. (本規約の変更)

(1) 当方は、本規約が定型約款であるとして、法令の規定に従い適宜本規約を変更することができるものとします。

(2) 当方は、本規約を変更するときは、変更後の本規約の施行時期および内容を当ファンボックス内に掲示することにより周知させるものとします。ただし法令の規定によりお客様の同意が必要である場合は、当方所定の方法にてお客様の同意を得るものとします。

6. (準拠法・裁判管轄)

(1) 本規約、当ファンボックスおよび本コンテンツは日本法に準拠し、日本法に基づいて解釈されるものとします。

(2) 本規約、当ファンボックスおよび本コンテンツに関する当方とお客様の間の一切の紛争(裁判所の調停手続きを含みます。)については、当方の住所地を管轄する地方裁判 所を第一審の専属的合意管轄裁判所とします。

7. (言語)

本規約は日本語を正文とします。参考のために英語による翻訳文が作成された場合であっても、日本語による記載と英語による記載との間で解釈に齟齬が生じた場合は、日本語による記載が 優先するものとします。

Terms of Use

These terms of use (hereinafter referred to as the "Terms") apply to the use by customers (meaning all persons who browse this FANBOX) of the fanbox (hereinafter referred to as the "FANBOX") opened by RinRinne (hereinafter referred to as the "We") on pixivFANBOX, as well as to the contents and other benefits that we provide to our supporters through this FANBOX in return for their support (hereinafter referred to as the "Contents").

When using our FANBOX or supporting us, please agree to these Terms before using or supporting us.

Article 1. (Operation of the FANBOX)

(1) We will provide new contents approximately twice per month for all support plans. However, we do not guarantee the number of times this content will be provided.

(2) When the Contents may be unavailable due to earthquakes, power outages, fire, accidents, illness, force majeure, malfunctions or maintenance of communication lines, communication equipment, computers and other information terminals or equipment used by us, or pixivFANBOX, or other unavoidable events that are not the responsibility of us, we reserve the right to suspend the provision of all or part of the FANBOX and the Contents or to discontinue new provision of the Contents for a period of time determined by us.

(3) We may, without prior notice to you, delete or change all or part of the Contents or any other Contents published by us in the FANBOX, or suspend publication of the Contents.

(4) We may suspend or terminate the operation of the Fan Box without prior notice to you.

(5) For support plans with a support amount exceeding 5,000 yen, we may provide some of the contents that may be considered slightly sexy. We ask for your understanding in advance.

(6) If we determine that a comment posted by a customer falls under 3. (Prohibited Matters), we may delete the comment without prior notice to the customer.

Article 2. (Attribution of rights)

All images, text, video, audio, and other contents in this FANBOX, including but not limited to the Contents, belong to us or third parties. You may not reproduce, publicly transmit, modify, transfer, sell, lend, or otherwise use the contents or comments published by us or posted by other users without our prior explicit permission.

Article 3. (Prohibited Matters)

The following actions are prohibited in connection with the use of the FANBOX and the Contents.

* Any act that violates the law or these Terms.

* Causing damage or disadvantage to us or any third party (including other supporters and customers), regardless of whether it is within our FANBOX, or regardless of the method, place, or purpose of publication of comments, blog posts, social networking posts, etc. and/or any act that causes (including that may cause) damage or disadvantage to us or any third party (including other supporters and customers), or damages our credibility, honor, or rights.

Article 4. (Disclaimer)

(1) We do not guarantee the accuracy, usefulness, truth, certainty, continuity, or noninfringement of third party rights with respect to the operation of this Fan Box or any content posted on the FANBOX.

(2) We shall not be liable for any disadvantage or damage incurred by you in connection with your use of the FANBOX, including but not limited to our response in accordance with these Terms, unless it is proven that the main cause of such disadvantage or damage was intentional or grossly negligent on our part.

Article 5. (Modification of these Terms)

(1) We reserve the right to modify these Terms from time to time in accordance with the provisions of laws and regulations, assuming that these Terms are the standard terms and conditions.

(2) When we change these Terms, we will make the revised these Terms known to you by posting the revised these Terms in the FANBOX. However, if the customer's consent is required by law, we will obtain the customer's consent in a manner prescribed by us.

Article 7. (Language)

The governing language of these Terms shall be Japanese. While English translation hereof may be made for reference purposes, the Japanese text shall prevail over any inconsistency between the Japanese text and the English text.
