Good News? Let's Wait and See (Pixiv Fanbox)

Well my friends the updated Terms Of Service are here (Pixiv Official English Annaucemnet) they will go into effect on December 15.

I highly recommend you to read the announcement and the attached reference.

I will give you guys my thougth including the changes that affect my work.

They adjust the terms that concerned "Prohibited Items" and "Items Requiring Revision". Aside from the obvious those two categories also define the severity of the punishment and the action to follow if some breaks the terms of use.

These actions vary depending on the service. In my case we will focus on pixivFANBOX

”Prohibited Items" are items that meet the following two conditions.

Types of work (examples)

-Live action

-Photo-realistic work that could be mistaken for live action

-Works that cause concerns about whether their creation may have involved the -victimization of living people or animals

As you guys can see none of the "Type of Work" that they listed affect me. I might be good at 3D but Photo-realistic is not my thing. So I am clear (I hope 😅).

Work content (examples)

-Sexual exploitation or sexual abuse of a minor (*1)

-Incest

-Bestiality

-Rape (or any other non-consensual sexual behavior)

-Non-consensual mutilation of a person or body part

-Any other content deemed inappropriate by pixiv

Now the "Work content" is another story depending on how you see it. But still there is only 2 items that might made me some trouble depending on their interpretation/definition.

Firts "Sexual exploitation or sexual abuse of a minor (*1)" comes to the definition of 'Minor" that they take as baseline. They reference that "Minor" is defined based on the definition set forth in the Act on Regulation and Punishment of Acts Relating to Child Prostitution and Child Pornography, and the Protection of Children.

Law Concerning the Regulation and Punishment of Acts Related to Child Prostitution and Child Pornography, and the Protection of Children

第二条　この法律において「児童」とは、十八歳に満たない者をいう。

(definition)

Article 2　The term "Minor" as used in this Act means a person under eighteen years of age.

Because my work is 3D images were everything is made using Inanimate/Abstract model made of binary code in a fictional enviroment then that definition could never apply to interpret the content of my work.

Something that we all already know but is necessary to state once again.

Now when it comes to "Incest" they do not point to a definition or a law which complicates things. If we consider incest as a sexual relation between persons that are family members. My work does not include persons just Inanimate/Abstract models made of binary code then I could say that these also does not aply to my work content. But because there is no definition of the word so they could just interpret what they want.

And that goes to everything else. I might understand and interpret their rules and definitions but they clearly stated that:

"*The following are just examples, and may be subject to change in the future.

*Some items which do not contain such content may also be deemed Prohibited Items."

With all that said it is my understanding that they are focusing on live-action content, wich they should.

Because there are a lot of artists like me that are doing this type of 3D work if Pixiv wanted to attack us they could just said it and be done with it.

Nonetheless I will make some changes and adjustments to my works to avoid breaking the new terms.

1- Work content: I will turned down every reference to the incest fetish on my future works. I will also remove reference in previous works. In most cases it will be only the title or some writen stuff that I place on each post. I might ended up using the good old fashion step-family tropes or the landlady/tenant relationship that they use on other sites 😉

2-Put in Private/Drafts all of my old post: After I release this month set I will put in private all of my old works in order to do the necessary modifications to then.

I suggest everyone to download and made copies right now.

I will do this before December 15. So that went the new terms of use take effect if pixiv sees something out of order they might go easy on me and I will only have to modify 1 post at a time. Eventually I will be bringing back each post so do not worry.

Let us hope that doing this it will keep me of their radar so that I can keep up creating amazing fantasy for all of you.
