今回は絵描きが写真を参考に絵を描くことについてです(･ω･)ﾉ

実はツイッターで、あなたはこの写真を使ってるんじゃないかと画像が送られてきました

確かにそれは私がタンブラーでいいなと思ってポーズを参考にした画像でした。

私は仕事やコミッション以外で絵を描くときは、全てではないですが写真のポーズを真似して練習していると言ってきました。具体的にはどんな感じかというとｄAのこの写真を横に置いて

この絵を描いています。(反転してあるのはこちらのほうが好みだったため)

私の最大の課題は人体デッサンだと思っているのでそのための練習です。

必要が無いので写真の作者に許可は取っていません。

問題はこれが著作権侵害にあたるかと言う事ですが

ポーズ、構図、人体に著作権は無く、キャラも違うので肖像権の侵害にもなりません。

非常に独創的で個性のあるポーズには著作権が発生する場合もありますが、ありきたりなポーズに著作権が発生することはありません。

ダメなら同じ場所で撮影した似たような背景の写真も,偶然ポーズが似てしまった写真や絵も全てだめになってしまいます。

もし画像を完全にトレースしていたり完璧に模写してそれを公開していれば著作権の侵害になります。(作者が訴えれば)

そうでなければブログで公開することにも問題はありません。

ちなみに画像をツイッターで送りつけてきた人は無断転載(しかもR-18)だったので

こちらは完全に著作権侵害だし迷惑行為になります。

絵描きに対し鬼の首を取ったかの如くトレパクを指摘する人がいますが、

大抵指摘する側に著作権の知識は無く、感情だけだったりします。

絵描きも指摘されると謝罪してしまう人が多いせいで理解が深まらないんだと思います。

著作権は親告罪なので、関係のない第三者が騒ぐ必要もないです。

この画像にしてもポーズは真似しているけど、私が参考にしてないと言い張れば証明するのは無理ですね。

私は写真を参考に練習していることを隠すつもりが無いので、意図的にキャンパスサイズを同じにしていたし、こういった指摘をしてくる人もいるだろうと想定してはいました。

でも面倒ごとを避けるためにも多少キャンパスサイズも構図も変えたほうが良いかもしれないね。

写真参考ばかりだと私も背徳感があるので、自分で構図もポーズも考えることもあるけど、最近は枚数優先でそういった絵が多かったのも事実なので

そこは反省し写真参考にしつつ少しアングル変えたりポーズ変更したりする練習をもっと取り入れていきたいです(･ω･)

I'm painting this picture. (It's inverted because I preferred this one.)

I think my biggest challenge is the human body drawing, so I practice for that.

I didn't get permission from the author of the photo because I didn't have to.

The question is, does this constitute copyright infringement?

Poses and compositions are not copyrighted and the characters are different, so there is no violation of portrait rights.

Copyright may be granted for very original and unique poses, but there is no copyright for ordinary poses.

If it doesn't work, then a photo with a similar background taken in the same location will not work either.

If you traced the image perfectly or copied it perfectly and published it, it would be an infringement of copyright (if the author sued). (If the author sues.)

Otherwise, there is nothing wrong with publishing your work on a blog.

If this is not done, most of your creative work will be ruined.

By the way, the person who sent the image to me on Twitter was unauthorized (and R-18).

This one is a complete violation of copyright and is a nuisance.

Some people point out the tree-parking against the artist as if it's a demon's head.

Most of the time the person pointing it out has no knowledge of copyright, just feelings.

I think it's because many painters also apologize when it's pointed out to them, and that's why they don't understand it better.

Copyright is a filibuster, so it's not right for an unrelated third party to make a fuss about it.

I'm imitating the pose in this image, but if you claim I'm not referring to it, it's impossible to prove it.

I intentionally kept the campus size the same because I didn't want to hide the fact that I was referring to a photo, and I assumed that some people would make these points.

But I might as well change the campus size and composition somewhat to avoid any hassle.

Sometimes I feel immoral if all I do is photographic reference, so I have to come up with my own compositions and poses, but it's true that I've had a lot of those pictures lately because I've been prioritizing the number of copies.

I'd like to practice changing the angle and pose of the picture while reflecting on it and using it as a reference.

Too many people mistakenly believe that painters are supposed to draw without looking at any material 💦.
