Having sex with someone while they are under duress is a crime. It’s called “rape in the 2nd degree”. His lawyer could have potentially gotten him acquitted by arguing that her continuation of the relationship or some kind of flirtatious behavior indicated that she did not believe that she would actually go to prison for declining his advances, that it was more of a kinky power fantasy and thus she was not actually under duress, depending on how misogynistic the jury was. it’s egregious that he was not at least charged, but in this case it’s the client who is the aggrieved party and not the state, so it’s her decision and not the attorney general’s. Perhaps she had the opportunity to press charges and decided that the civil consequences were enough. Or did not want to relive it over and over and be subject to cross examination. Or many of the myriad reasons rape victims choose not to press charges the majority of the time particularly when they have a sort of friendship or mixed feelings toward the perpetrator. Many cops, correctional officers etc are doing sentences in jail for this same crime, essentially detaining someone and demanding sex in exchange for their freedom.
